PREPGUARD TERMS OF SERVICE

1. About us

Welcome to PrepGuard. These Terms of Service govern your use of the PrepGuard website and purchases made through our online store.

In these Terms, “PrepGuard”, “we”, “us” and “our” refer to PrepGuard.

Our online store is powered by Shopify. Products purchased through the PrepGuard store are sold to you by PrepGuard unless expressly stated otherwise.

By using our website or placing an order, you agree to these Terms together with our Privacy Policy, Return and Refund Policy and Shipping Policy.

Nothing in these Terms affects your statutory rights as a consumer.

2. Using our website

You may use our website only for lawful purposes.

You must not misuse the website, attempt to gain unauthorised access to it, introduce malicious software, interfere with its operation, or use it in a way that infringes the rights of PrepGuard or any third party.

You are responsible for ensuring that information you provide when placing an order is accurate and complete.

3. Products and product information

We take reasonable care to ensure that product descriptions, specifications, images and prices are accurate.

Product photographs are intended to represent the products as accurately as reasonably possible, although colours and appearance may vary depending on your device or screen.

Some product information and images may be supplied by manufacturers, distributors or fulfilment partners.

Product availability may change without notice. We may discontinue products or restrict quantities where reasonably necessary.

Nothing in this section excludes or limits your rights where goods are faulty, not as described, unsatisfactory or otherwise fail to conform to your statutory rights.

4. Orders

When you submit an order, you are offering to purchase the products in that order.

Receiving an automated acknowledgement does not necessarily mean that we have accepted your order. A contract is formed when we accept the order and confirm that it is being processed or fulfilled.

We may refuse or cancel an order where reasonably necessary, including where a product is unavailable, there is an obvious pricing or product-information error, payment cannot be authorised, or we reasonably suspect fraud or misuse.

If we cancel an order after payment has been taken, we will refund the relevant amount.

5. Prices and payment

Prices are shown in pounds sterling (GBP) unless stated otherwise.

The total amount payable, including any applicable delivery charge, will be shown during checkout before you place your order.

We may change prices at any time, but changes will not normally affect an order that we have already accepted.

If an obvious pricing error occurs, we may contact you to correct the error or cancel and refund the affected order.

Payments are processed through the payment methods made available at checkout.

6. Delivery and fulfilment

PrepGuard works with suppliers and fulfilment partners, so products within the same order may sometimes be dispatched separately or arrive at different times.

Delivery estimates are estimates rather than guaranteed delivery dates unless we expressly agree otherwise.

We are not responsible for delays caused by events genuinely outside our reasonable control, but this does not affect any rights you have under UK consumer law where goods are not delivered within the legally required or agreed timeframe.

Risk in goods remains with us until the goods come into your physical possession, or the physical possession of a person identified by you to receive them, except where applicable law provides otherwise.

7. Returns, cancellations and refunds

Our voluntary 30-day return policy and information about your statutory cancellation rights are set out in our Return and Refund Policy.

Our voluntary return policy is additional to your statutory rights and does not replace or restrict them.

Please contact us before returning a product. Some products are fulfilled by different suppliers, meaning the correct return destination can vary.

Do not return products to our correspondence address or directly to a supplier unless we have instructed you to do so.

8. Faulty or misdescribed goods

Goods supplied by PrepGuard must meet the requirements of applicable UK consumer law.

Nothing in these Terms limits your legal rights where goods are faulty, damaged, not as described, not of satisfactory quality or otherwise do not conform to the contract.

Depending on the circumstances and applicable law, you may be entitled to remedies including a refund, repair or replacement.

9. Product safety and responsible use

Some products sold by PrepGuard are intended for outdoor, camping, emergency-preparedness or backup use.

You must follow the manufacturer's instructions, warnings and safety information supplied with a product.

Products involving heat, flames, fuel, batteries, electrical equipment, water treatment or similar activities should only be used for their intended purpose and in accordance with their safety instructions.

Outdoor-only products, including camping stoves or other combustion appliances labelled for outdoor use, must not be used indoors or in enclosed spaces.

PrepGuard preparedness information is provided for general guidance and does not replace manufacturer instructions, emergency-service advice or professional advice where appropriate.

Nothing in this section excludes liability that cannot legally be excluded.

10. Third-party fulfilment and services

We may use manufacturers, distributors, carriers and other third parties to store, fulfil or deliver products.

Where you purchase through the PrepGuard store, PrepGuard remains your point of contact regarding your order unless we expressly tell you otherwise.

The use of a fulfilment partner does not remove any statutory consumer rights you have against us as the retailer.

11. Shopify

Our online store is powered by Shopify, which provides technology used to operate the store and process aspects of your interaction with it.

Purchases made through the PrepGuard store are transactions with PrepGuard and not with Shopify.

Shopify may process information in connection with providing its services to us. Further information about the handling of personal information is contained in our Privacy Policy.

12. Intellectual property

Content created by PrepGuard, including our branding, original text, graphics and website design, is protected by applicable intellectual-property laws.

Product names, trademarks, photographs and other material belonging to manufacturers, suppliers, Shopify or other third parties remain the property of their respective owners or licensors.

You may use our website for personal, non-commercial purposes. You may not reproduce or commercially exploit our original content without permission except where permitted by law.

13. Third-party links

Our website may contain links to websites or services operated by third parties.

We are not responsible for the content or operation of independent third-party websites. You should review their applicable terms and privacy information before using them.

14. Website availability

We aim to keep our website available and accurate but cannot guarantee uninterrupted or error-free access.

We may update, suspend or change parts of the website where reasonably necessary, including for maintenance, security or improvements.

15. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.

If you are a consumer, we are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill, subject to applicable law.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed.

Products sold through the consumer PrepGuard store are intended primarily for personal and household use. We are not responsible for business losses such as loss of profit, revenue or business opportunity arising from consumer purchases, to the extent permitted by law.

16. Privacy

Our collection and use of personal information is described in our Privacy Policy.

Because our store is powered by Shopify and may use other service providers to process payments, fulfil orders and deliver products, personal information may also be processed by those providers where necessary to provide their services.

17. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes to our services, business practices or applicable law.

The Terms applicable to an order will normally be those in effect when the order is placed, except where a change is required by law.

18. Governing law

These Terms are governed by the laws of England and Wales.

If you are a consumer living elsewhere in the United Kingdom, you will retain any mandatory protections provided by the law applicable to you, and nothing in these Terms deprives you of rights that cannot legally be excluded.

Any dispute may be dealt with by the courts having jurisdiction under applicable UK law.
